Privacy Policy

FOREVER ONE MEMORIAL, a project of the Vegas Strong Fund, a Nevada non-profit corporation (VSF), is committed to protecting the privacy of our donors and the personal information you may share with Forever One Memorial or that Forever One Memorial holds. Forever One Memorial values our donors’ trust and recognizes that maintaining this trust requires the charity to be transparent and accountable to our supporters and the public at all times. This Donor Privacy Policy (the “Policy“) describes the information collected about our donors and Forever One Memorial’s practices for using, maintaining, protecting, and disclosing that information. 

  1. Information Collected and Maintained. Forever One Memorial collects and maintains personal information that you, our donors, provide to us when you:
    1. Contact us by phone, mail, or email, in person, or via our website.
    2. Register for an event.
    3. Make a contribution, either on our website, at a special event, over the phone, or by mailing in a check.
    4. Navigate through our website.

From time to time, we may collect personal information from you in ways not described above, subject to your express approval.

  1. Types of Information. Forever One Memorial collects and maintains the following types of information about our donors:
    1. Personal information, including:
      1. Contact information, such as name, address, email, and telephone number.
      2. Giving information, including types and amounts of donations and credit card information. We utilize secure transaction methods when collecting credit card information over the internet. Forever One Memorial does not disclose credit card account information provided by our donors, except for the proper processing of donations.
      3. Information on events attended and publications received.
      4. Any other information provided by the donor to Forever One Memorial, such as public comments or posts on Forever One Memorial’s website or social media channels.
    2. Non-personal information that does not personally identify you, including information that is anonymized, aggregated, or publicly available when not combined with non-publicly available information about you.
    3. Information about your equipment, browsing actions, and patterns, including information automatically collected through technical methods such as:
      1. Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our website.
      2. Flash Cookies. Certain features of our website may use local stored objects to collect and store information about your preferences and navigation to, from, and on our website. Flash cookies are not managed by the same browser settings as are used for browser cookies. 
      3. Web Beacons. Pages of our Website and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Forever One Memorial, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity). 
  2. Confidentiality. All information about any financial and non-financial transactions between you and Forever One Memorial is considered highly confidential and we employ appropriate security measures designed to protect it. While the information is kept confidential, it is shared with Forever One Memorial’s board members, staff, volunteers, and professionals and with any of Forever One Memorial’s parent organizations or subsidiaries on a need-to-know basis and in compliance with all laws, regulations, court orders, or other governmental requests.
  3. Use of Personal Information. Forever One Memorial collects and maintains personal information to:
    1. Establish a relationship and communicate with you about Forever One Memorial, including our programs, special events, and funding needs.
    2. Learn about our donors and what matters to you.
    3. Process donations and event registrations and issue tax receipts.
    4. Comply with all laws and regulations, including reporting requirements.
    5. Plan future fundraising activities and events.
    6. Analyze giving patterns.
    7. Solicit feedback from you by conducting surveys. 

Forever One Memorial uses industry standard safeguards to protect your personal information against the unauthorized access, use, alteration, or destruction of your personal information. Forever One Memorial will not share, sell, or exchange your personal information with any other entity for third-party fundraising or marketing purposes.  To the extent that a third-party service provider is used to process any donations, the provider is bound by strict confidentiality rules, and your information will only be used to the extent necessary to process the donation.

  1. Communications. Forever One Memorial will from time to time communicate with you, including by telephone, text, email, and mail, concerning Forever One Memorial’s charitable activities, events, and requests for future support. Forever One Memorial will not call or email you or send mailings to you on behalf of other organizations without your express consent. To opt out of receiving these communications, you may contact Forever One Memorial as described in the “Contact Us” section below or by clicking on the “unsubscribe” link in any email communications.
  2. Records Retention and Destruction. Forever One Memorial complies with all Internal Revenue Service, state, and local regulations and Forever One Memorial’s internal policies governing the retention, management, and destruction of donor information collected and maintained by Forever One Memorial.
  3. Accessing and Correcting Your Personal Information. You can review and request changes to the personal information that Forever One Memorial has collected about you by contacting Forever One Memorial as described in the “Contact Us” section below. However, please be aware that Forever One Memorial may not accommodate a change request that would impact record retention or other operational requirements like remembering email opt-out preferences, violate any law or legal requirement, or cause the information to be incorrect. Deleting your personal information may also require deleting your user account (if any). 
  4. Changes to the Policy. This Policy is current as of the date stated at the top of this Policy. Forever One Memorial reserves the right to amend this Policy from time to time. Forever One Memorial will notify you of any material changes to the Policy by email to the primary email address specified in your account or through a notice on the Website home page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Website and this privacy policy to check for any changes.
  5. Children Under the Age of 13. Forever One Memorial’s website is not intended for children under 13 years of age. No one under age 13 may provide any information to or on the website. Forever One Memorial does not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on this website or through any of its features, register on the website, make any purchases through the website, use any of the interactive or public comment features of this website, or provide any information about yourself to Forever One Memorial, including your name, address, telephone number, email address, or any screen name or user name you may use. If Forever One Memorial learns it has collected or received personal information from a child under 13 without verification of parental consent, Forever One Memorial will delete that information. If you believe Forever One Memorial might have any information from or about a child under 13, please contact Forever One Memorial as described in the “Contact Us” section below.
  6. Donor Bill of Rights. Forever One Memorial works to follow the Donor Bill of Rights developed by the Association of Fundraising Professionals (AFP), Associations for Healthcare Philanthropy (AHP), the Council for Advancement and Support of Education (CASE), and the Giving Institute: Leading Consultants to Non-Profits. To address the concerns and challenges arising from Internet charitable giving, Forever One Memorial also works to follow the eDonor Bill of Rights, developed by the AFP and intended to complement the Donor Bill of Rights. A copy of the Donor Bill of Rights and eDonor Bill of Rights may be downloaded from the Council for Advancement and Support of Education (CASE), or you may contact the Non-Profit as described in the “Contact Us” section below.
  7. Contact Us. To opt out of receiving communications from the Non-Profit, to review the personal information that the Non-Profit has collected about you, or to ask any other questions regarding this Policy, please contact the Non-Profit at the below address or email, or submit your request via the Non-Profit’s “Contact Us Form” on the Non-Profit’s website.

Introduction

Disclosing Your Personal Information for a Business or Commercial Purpose

We may disclose your personal information to service providers and third parties in order to carry out specific business or commercial purposes. In the preceding 12 months, we have disclosed the following categories of consumer personal information for business or commercial purposes to service providers and the following categories of third parties:

  • Identifiers to data analytics providers and lead generation services.
  • Personal information described in the California Customer Records Statute to lead generation services.
  • Internet or other similar network activity to data analytics providers.
  • Geolocation data to data analytics providers. 

We do not sell your personal information.

Your Rights Under The CCPA

As described in more detail below, the CCPA provides you with certain rights regarding the collection, use, and disclosure of your personal information.

The Right to Know About Personal Information Collected, Used, or Disclosed

You have the right to request that we provide you with certain information about the personal information we collect, use, or disclose about you as well as the categories and specific pieces of information that we have collected about you in the 12 months before your submission of a verifiable consumer request. Specifically, you have the right to request the following information:

  • The specific pieces of personal information we have about you.
  • The categories of personal information we have collected about you, including:
    • The categories of personal information we have collected about you in the past 12 months.
    • The categories of sources from which the personal information about you was collected.
    • Our business or commercial purpose for collecting your personal information.
  • If we shared your personal information:
  • The categories of personal information that we disclosed about you for a business purpose in the past 12 months and, for each category identified, the categories of third parties to which it disclosed that particular category of personal information; and
  • The categories of third parties that we share personal information.
  • If we sold your personal information:
  • Our business or commercial purpose for selling your personal information.
  • The categories of your personal information that we have sold about you in the past 12 months and, for each category identified, the categories of third parties to which it sold that particular category of personal information.

A household may request to know aggregate household personal information by submitting a verifiable consumer request. Also, unless the household has a password-protected account, if all consumers in a household jointly request access to specific pieces of information for the household, we can individually verify the identity of all the members of the household, and we can verify that each member is a current member of the household, then we will comply with the request.

However, there is certain information that we will not disclose to you. This information includes but is not limited to your Social Security number, driver’s license number or other government-issued identification number, financial account number, any health insurance or medical identification number, an account password, security questions and answers, or unique biometric data generated from measurements or technical analysis of human characteristics.

The Right to Request Deletion of Personal Information

You have the right to request that we delete any personal information that we have collected from you and maintained about you. Once we receive and confirm your verifiable consumer request, if we determine that we must comply with a deletion request and delete your personal information from our records, we will also direct any service providers we work with to also delete your personal information from their records. If we store any of your personal information in our archives or back-up systems, we will delete your information once the systems are accessed, restored, and/or used.

A household may request the deletion of aggregate household personal information by submitting a verifiable consumer request. In addition, unless the household has a password-protected account, if all consumers in a household jointly request deletion of household personal information, we can individually verify the identity of all the members of the household, and we can verify that each member is a current member of the household, then we will comply with the request.

Please note that we may deny your deletion request for a number of different reasons, which are identified in the CCPA.

This right does not apply to Business Consumers.

Exercising Your Rights Under The CCPA

Submitting a Verifiable Request to Know or Request to Delete

To exercise your Right to Know or your Right to Delete, please submit a verifiable consumer request to us by either:

  • Contacting us pursuant to the Contact Us section of this Privacy Policy; or
  • Filling out the Right to Know Form Request or Right to Delete Form Request. [next page]

To submit a verifiable consumer request, you (or your authorized agent) will be asked to provide identifying information that enables us to verify you with information in our system.

Only you (or an authorized agent) may make a verifiable consumer request. You may also make a verifiable consumer request on behalf of your minor child.

Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights.

Shine The Light Law

California Civil Code Section 1798.83 permits users who are California residents to request certain information regarding the disclosure of Personal Information to third-parties, including our information sharing practices, including the names and addresses of those businesses with whom we have shared your Personal Information, for direct marketing purposes. Introduction

This California Privacy Notice is for California Residents and supplements Forever One Memorial’s Privacy Policy. This statement describes how we collect, use, disclose, share, and retain personal information, and outlines your rights under the California Consumer Privacy Act (CCPA), the California “Shine the Light” law, and other California privacy laws. It also explains how California residents (“you” or “consumers”) can exercise those rights regarding their personal information.

What Is Personal Information

Personal information is information that identifies, relates to, describes, or is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household. Personal information does not include publicly available information, such as information lawfully made available from government records, or de-identified or aggregated consumer information.

Certain personal information is exempt from the CCPA, including:

  • Information covered by specific federal or state privacy laws (e.g., HIPAA, the Fair Credit Reporting Act, the Gramm-Leach-Bliley Act).
  • Personal information collected in the course of your role as an employee, contractor, or job applicant with Forever One Memorial.

Personal Information We Collect, Use, and Share

In general, in the past 12 months, we may have collected the following categories of personal information for business purposes:

  1. Identifiers: Name, postal address, email address, IP address, account name, and other similar identifiers.
  2. Personal Information (California Customer Records Statute): Name, address, phone number, credit card information, or other financial or health information.
  3. Characteristics of Protected Classification: Age (40 years or older), gender, marital status, physical or mental disability, sexual orientation, veteran or military status, genetic information.
  4. Commercial Information: Records of personal property, services or products purchased, obtained, or considered.
  5. Biometric Information: Fingerprints, faceprints, voiceprints, and other biological or physical data.
  6. Internet or Other Network Activity: Browsing history, search history, and interactions with our website, applications, or advertisements.
  7. Geolocation Data: Physical location or movements.
  8. Professional or Employment-Related Information: Current or past job history, performance evaluations.
  9. Non-Public Education Information: Grades, transcripts, student records.
  10. Inferences: Profiles reflecting preferences, behavior, and characteristics.

We collect this information from:

  • You, as a consumer.
  • Service providers, data analytics services, and lead generation services.

Purpose Of Collection

We do not sell or share your personal information, including your sensitive personal information. We use the personal information we collect for the following purposes:

  • Account Services: To manage your account and provide services, products, or information you request and to communicate with you.
  • Security and Fraud Detection: To detect and prevent fraud, malicious activities, or illegal activities.
  • Marketing and Advertising: To send you promotional materials and marketing communications.
  • Legal Obligations: To comply with legal obligations, to enforce our agreements and our terms of use.
  • Product and Service Improvement: To maintain, service, and improve our services and offerings.
  • Business Interests: For the administration and protection of our business and to fulfill business purposes such as auditing and other transactions.

Disclosing Your Personal Information for Business Purposes

We may disclose your personal information to third parties for business purposes, such as:

  • Service providers who assist with web hosting, analytics, collections, or customer service.
  • For security, fraud detection, or legal compliance purposes.
  • Other business transactions.
  • In compliance with legal obligations, including court orders or subpoenas.

Your Rights Under the CCPA

As a California resident, you have the following rights under the CCPA:

  1. Right to Know: You can request the categories of information and the specific pieces of personal information we’ve collected about you.
  2. Right to Deletion: You can request that we delete the personal information we’ve collected about you, subject to certain exceptions.
  3. Right to Correct: You can request correction of inaccurate personal information.
  4. Right to Opt-Out: You can request to opt-out of the sale of your personal information (We do not sell personal information).
  5. Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.

To exercise any of these rights, please submit a verifiable consumer request to us by either:

Shine the Light Law

Under California’s Shine the Light Law (California Civil Code Section 1798.83), you may request information about how your personal information has been shared with third parties for their direct marketing purposes. To make such a request, please contact us as provided in the Contact Us section of this Privacy Policy.

Exercising Your Rights Under the CCPA

To exercise your rights to know, delete, correct, or opt-out, please submit your request through the following:

  • Contact Us section.
  • Right to Know or Right to Delete forms.

We will respond to your request within 45 days. If necessary, we may extend the response period for up to 45 additional days with notice to you. In order to verify your request, we may require you to submit personal information (such as an email address or telephone number) that will allow us to confirm that you are the consumer about whom we have collected information, or you are an agent authorized by the consumer to act on their behalf.

Retention

Unless otherwise stated above, we will retain categories of your personal information only for as long as necessary.  We make this determination based on our relationship with you, applicable laws, and our data retention policies.  We will retain each category of your personal information for as long as we have a relationship with you and for a reasonable period thereafter.

When determining how long to retain each category of personal information after we no longer have a relationship with you, we take into account how long parties like you usually want to continue hearing from us, our legal obligations and the expectations of regulators, as well as the length of time information is needed for internal audit purposes and to exercise or defend our legal rights.

We also consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

We review our retention periods for each category of personal information on a regular basis, and all data is retained in compliance with applicable data protection laws.
